Terms and privacy

Here you will find the terms for coaching with noperfectweek and information about the processing of personal data. The terms apply together with the individual written agreement you receive before coaching begins.

Who can enter into an agreement

Coaching is offered to persons aged 18 or over. Coaching may be offered to customers resident in other countries. Danish law governs the agreement, but the customer retains the mandatory consumer protection that applies in the customer’s country of residence.

What coaching is and is not

noperfectweek offers individual running coaching and training guidance. The specific content, scope and practical contact arrangements are set out in the individual agreement.

Coaching is not medical treatment, physiotherapy, injury diagnosis, psychotherapy or clinical nutrition treatment. noperfectweek does not make diagnoses and does not guarantee specific results, finishing times, completion or an injury free coaching journey.

You are responsible for seeking an assessment from a relevant authorised healthcare professional in the event of illness, injury or symptoms requiring professional healthcare assessment. You should not send diagnoses, medical records or other confidential health information through the contact form or ordinary email.

Entering into the agreement

A coaching agreement is entered into when you receive and accept an individual written agreement. The agreement states at least the start date, trial period, coaching duration, price, method of payment, whether the coaching ends or continues after the agreed period, and any special terms.

The individual agreement and these terms constitute one complete agreement. Joining a waiting list, a call or an enquiry is not in itself a coaching agreement. If the individual agreement expressly departs from a term here, the individual agreement applies unless mandatory law provides otherwise.

Price and payment

The first month is a trial period and costs DKK 475 including VAT. The trial period may only be used once per customer and cannot be used again following a pause, renewal or later coaching journey.

After the trial period, the price is DKK 950 including VAT per full month. All coaching is billed in full months. If the agreement continues, coaching is paid monthly in advance unless the individual agreement sets out another lawful payment schedule.

For advance payment of at least six months after the trial period, a 10 percent discount is given on the total price for the prepaid months. The trial period is never included in the discount calculation. The individual agreement states the exact prepaid period and total price.

Payment is made by invoice or payment link. The payment deadline is 14 calendar days, unless the individual agreement expressly states otherwise. Coaching begins only when the agreed first payment has been received. In the event of late payment, noperfectweek may charge interest and reminder fees to the extent permitted by law.

If Nolio charges for the customer’s access to the platform, the customer enters into the agreement with Nolio and pays Nolio directly. Such a cost is not included in the coaching price unless the individual agreement expressly states otherwise.

Trial period, duration and continuation

The trial period is the first month of the first coaching journey. It forms part of the original agreement and does not require the parties to enter into a new agreement after the end of the month.

Coaching may be agreed for one full month or more. The individual agreement specifies whether coaching ends automatically on a particular date or continues month by month until terminated. A fixed term coaching journey ends automatically upon expiry when this has been agreed in writing.

Right of withdrawal and commencement

If you enter into the agreement through distance selling or away from the company’s business premises, you generally have a 14 day right of withdrawal from the day the agreement is entered into. You may withdraw by sending a clear written notice to patrick@noperfectweek.dk.

You may expressly request that coaching begins before the withdrawal period ends. If you withdraw in time after such an early commencement, you must pay a reasonable amount corresponding to the coaching provided up to your notice of withdrawal. The individual agreement obtains the necessary request and acknowledgement before early commencement.

Termination and refunds

An ongoing agreement may be terminated by the customer in writing with one month’s notice to the end of a month. Notice of termination must be sent to patrick@noperfectweek.dk. Termination takes effect when it is received, and noperfectweek confirms it in writing.

If the customer terminates after the withdrawal period has ended, amounts paid for a paid and commenced period are normally not refunded. This does not affect the customer’s mandatory rights. If the customer has paid for a period after the agreement’s lawful end date, the amount for that period will be refunded without undue delay.

For agreements on ongoing coaching, the statutory right of termination after five months applies. Where this right applies, the customer may terminate with one month’s notice to the end of a month, even if a longer period has been agreed. In the event of advance payment, a refund is made to the extent required by law.

Calls, pauses and adjustments

Cancellation of an agreed call must be given at least 24 hours before the agreed time. In the event of later cancellation or non attendance, noperfectweek may regard the call as completed. noperfectweek may choose to offer a new time, but is not obliged to do so.

A pause is not an automatic right. A pause requires the company’s prior written approval, and the individual agreement or written approval sets out the length of the pause, payment and any extension of coaching.

In the event of short term illness or injury, training may, where professionally appropriate, be adjusted within the scope of coaching. This does not replace professional healthcare assessment.

When noperfectweek ends coaching

noperfectweek may pause coaching or terminate the agreement with immediate effect in the event of a material breach. This may include material or repeated non payment, repeated failure to cooperate, abusive or threatening conduct, misuse of platforms or materials, or circumstances that make continued coaching professionally indefensible. Where reasonable and possible, the customer will first be given the opportunity to remedy the situation.

If noperfectweek ends the agreement without a breach by the customer and cannot provide coaching already paid for, a reasonable solution will be found in the circumstances. This may be an adjustment, postponement, a replacement service or a proportionate refund. This does not limit the customer’s mandatory rights.

noperfectweek is not liable for delay or non delivery caused by circumstances beyond reasonable control. In such cases, coaching may be adjusted, postponed or ended to the extent permitted by law.

Changes to price and terms

noperfectweek may change the price or other terms of an ongoing agreement where the change is objectively justified, for example by changed costs, legal requirements or material changes to the service. The change will be notified in writing with the current month plus one month’s notice. The customer may terminate the agreement with effect before the change takes effect if the law grants that right.

Complaints

Write first to patrick@noperfectweek.dk, so that we can try to resolve the issue.

If a consumer dispute is not resolved, you can check whether the case meets the conditions for consideration by the Mediation Team for Consumer Complaints and the Consumer Complaints Board.

Free 20 week marathon programme

When you request the programme, No Perfect Week processes your name, email address and the necessary technical information from the form. The information is used to give you access to the PDF file and send the link to your email.

The information is not used for a newsletter or other email marketing. That requires a separate and voluntary choice.

Information about downloading the programme is deleted no later than six months after the link is sent, unless it remains necessary for security or a legal claim.

Information, purpose and legal basis

When you contact us, your name, email address, subject, message and necessary technical information are processed to answer your enquiry and protect operations. The legal basis is the steps you request before a possible agreement, and noperfectweek has a legitimate interest in handling ordinary enquiries.

For coaching, contact information, agreement information, payment information, necessary correspondence and training information are processed. The processing is necessary to enter into and fulfil the agreement, manage payment and comply with legal obligations.

Information about illness, injury or other health matters is processed only if necessary for coaching and you have given separate explicit consent. You may withdraw consent for future processing at any time. This may mean that noperfectweek cannot adapt training to the relevant circumstances. Withdrawal does not affect the lawfulness of processing that has already taken place.

Nolio

Nolio is used as the training platform. When you create or share information through Nolio in relation to coaching, noperfectweek may access the information you share with your coach to plan, follow and adapt your training. Use only information relevant to coaching and do not use free text fields for confidential medical information.

Nolio’s own terms and privacy policy also apply to your use of the platform. If Nolio charges for your access, this is an agreement between you and Nolio. noperfectweek processes information from Nolio only to the extent necessary for coaching and in accordance with this privacy information.

Waiting list

The waiting list processes your name, email address, sign up date, documentation of consent and any withdrawal. Its sole purpose is to send a notification when coaching opens or when a place becomes available. The legal basis is your active consent.

The waiting list is managed manually by Patrick Bloem in a local file. Information is deleted when consent is withdrawn and otherwise 12 months after sign up, unless you actively renew your consent. Information is not used for newsletters or other marketing content.

Recipients and suppliers

Simply.com provides hosting and email. WordPress and WPForms are used for the website, contact form and marathon programme form. Google Analytics through Site Kit by Google is used for analytics when you have consented to analytics cookies. Nolio is used as the training platform. Suppliers may process information only to the extent necessary for their role, and No Perfect Week puts the necessary agreements and security measures in place.

Information may also be disclosed if required by law or necessary to establish, exercise or defend a legal claim. If a supplier transfers personal data outside the EU or EEA, the transfer mechanism required by data protection rules is used.

Retention and deletion

Ordinary enquiries are normally deleted no later than six months after the enquiry has been concluded. Information from coaching is normally deleted 12 months after the end of the collaboration. Accounting records and other necessary documentation are kept for the period required by law.

When a retention period expires, the information is deleted or anonymised unless it remains necessary for a documented legal claim or legal obligation.

Your rights and complaints

Depending on the situation, you may have the right to access, rectification, erasure, restriction, objection and data portability. Write to patrick@noperfectweek.dk, if you wish to exercise your rights. noperfectweek may ask for the information necessary to confirm your identity.

You can complain about the processing of personal data to Datatilsynet.

Cookies, analytics and changes

The website uses technically necessary cookies and technical information necessary for operation and security.

If you accept analytics cookies, No Perfect Week uses Google Analytics through Site Kit by Google to understand how the website is used. Analytics may include information about visits, pages used, device and browser. The information is used to improve the website and its content.

Analytics cookies are set only when you have given consent in the cookie banner. You may change or withdraw your consent at any time through Cookie choices in the footer.

The cookie policy describes the cookies and similar technologies used, including their purpose, supplier and retention period.
